Window contract before the funding application: What do you release for signature?
Prepare your conditional window contract for a new German BEG EM application. Keep signature, application, approval and operational release separate.
A signed window quotation can be the next sales step for your business. For a planned replacement with German BEG funding in mind, however, the signature must fit the procedure the customer intends to use. You need a particular contractual position before the application. You also want to prevent your office from treating the signature as an order to the manufacturer or a confirmed installation date. A clear contract discussion prepares precisely that decision.
We start with a technically prepared window project in an existing building in Germany. The customer now wants to submit a new BEG EM application for a building-envelope measure. This article describes your own route to a conditional supply or service contract. It provides no contract clause and assesses no individual agreement. Applications already submitted under earlier rules require a separate check of the applicable version. The workflow below concerns the currently documented rules for new applications.
Decide which document the customer should sign
Put the intended contract version in front of you. Which windows, installation work and additional services should the customer commission through it? Refer to the specification already agreed and the clearly identified attachments. The question now is more specific than whether the prospective customer wants new windows. They need to understand the work your business offers contractually and where the funding commitment is addressed.
The current BAFA general guidance on BEG EM applications requires a concluded supply or service contract with a suspensive or resolutory condition concerning the funding commitment by the time of application at the latest. Merely sending a non-binding cost overview does not meet that described contractual position. Your sales team therefore has a specific task: prepare the intended contract rather than simply suggest that the customer somehow applies for funding first.
Have the responsible contract adviser assess how your existing contractual process incorporates that condition for this project. Mentioning the customer’s funding intentions in a covering message does not answer the question. Your office should know which complete version was checked and may be sent to the customer. You cannot establish the legal effect of a particular provision by assembling your own wording from several online templates.
Connect the contract with the technical application documents
For building-envelope measures, BAFA expressly includes windows and requires an energy efficiency expert. A general contractor declaration used in other funding segments does not replace that step for the window project. Clarify with the customer which expert supports the application and which quotation version that expert has received.
Before application, the energy efficiency expert prepares the technical project description, known as the TPB. After implementation, the technical project evidence, or TPN, belongs to the subsequent procedure. Your team now needs the contract scope and technical application basis to concern the same project. An older window schedule may look complete in the folder while no longer matching the specification the customer is supposed to sign.
Refer a specific discrepancy to the responsible person. If the current quotation omits an item already discussed, or the planning documents specify something different, have that point reconciled. Matching filenames do not establish funding eligibility. Technical minimum requirements, the building context and necessary evidence remain part of the assessment of the particular measure. An isolated glazing value or a general product promise cannot replace it.
Include an expected implementation date in the contract preparation
The contract must contain the expected implementation date. Under section 9.4.1 of the current directive, the approval period runs for 36 months from receipt of the grant decision or funding commitment. The expected implementation date must fall within that period. Explain the connection using the actual project. An estimated application processing date is neither an existing decision nor your window manufacturer’s confirmed delivery time.
Before releasing the document for signature, therefore, check with scheduling which expected date you can give on a reasonable basis. What preparation remains, what coordination is needed for procurement, and what work can your business actually plan? That operational assessment concerns the current scope. You need neither invent an installation slot nor turn the funding period into a promised completion time for your company.
If the customer asks for a binding date, address that expressly through your actual contractual process. The funding procedure and your specific scheduling agreement have different purposes. Record what your business has actually stated and what coordination still follows. The person sending the contract can then explain the expected implementation date without adding a delivery or manufacturing guarantee in passing.
Keep separate evidence of signature and application receipt
Once the checked contract version has been released for signature, explain the next step and who will take it. Accepting a window order does not automatically authorise your business to represent the applicant in the funding procedure. If somebody is to act for the applicant, clarify this separately through the intended BAFA process. Contact with the energy efficiency expert and authority to submit an application are different things.
The current guidance distinguishes possession of the contract from submission. The applicant must have the conditional supply or service contract; section 6 says the contracts themselves do not have to accompany the application. Do not invent a general compulsory upload of the window contract. Prepare a complete, identifiable document and agree how the customer receives it and can locate it in their own records.
Then record the actual event. Receiving a signed contract version is a different stage from a submitted funding application. Section 9.2.1 of the directive makes receipt by the administering body decisive for application timing. If your office knows only the customer’s intention, keep it identified as such. When the customer reports on the application, ask about its actual status rather than infer confirmed receipt from a document having been sent.
Do not turn an application into automatic permission to carry out the work
The current directive generally treats the conclusion of a supply or service contract attributable to execution as the start of the project and requires the described funding condition for the contract before application. Planning and advisory services alone do not constitute that start. This distinction gives no blanket clearance for everything your company internally calls preparation. A project already started or unclear in this respect needs a specific assessment.
After application, a measure may begin before the decision at the applicant’s own risk. BAFA expressly warns that measures carried out may turn out to be ineligible. Tell the customer neither that legislation generally prohibits starting until approval nor that an early start is risk-free. If your business wants to await the decision in this particular case, explain that as the approach you have actually agreed.
For ordering, manufacture and installation, your responsible person needs the checked current contract and project status. Your office does not automatically convert a signature, TPB identifier or notification of application receipt into a manufacturing order. Decide who releases each next step within your existing process. The funding rules’ allowance for an early start replaces neither assessment of your contractual terms nor the commercial decision by your customer and business.
Follow a hypothetical project through to the signature decision
Consider an expressly fictional case. Several replacement windows for an existing house have been technically prepared. The owner wants to submit a new BEG EM application and asks for the document to sign beforehand. The office has the quotation that was explained, but the expert is still working with an earlier schedule. The employee therefore does not release an old version as the appropriate contract basis.
They identify the discrepancy and arrange for quotation and technical project basis to be aligned. The responsible contract adviser checks the existing contractual process, including the funding condition. Scheduling clarifies the expected implementation date to be included. Only then does the responsible person decide which complete version will be sent for signature. The concrete result is a prepared conditional contract covering the same work to which the subsequent application is intended to refer.
If the owner instead wanted only an initial cost indication, releasing a contract would not yet be the appropriate next step. The business would first clarify that different request. In our case, however, the customer is ready to discuss the business’s own conditional contract for the application process. That decision distinguishes the project from a non-binding quotation simply filed in funding records without further discussion.
Continue with the current order after the decision
When the customer reports a positive decision, open the associated contract version and the actual scope of the measure. Check whether anything has changed since signing. A different window size, specification or additional service is not silently treated as covered by the same funding decision. Refer the affected question to the expert or responsible administering body; your business explains its own services.
The directive requires deviations from the approved measure to be reported to the administering body without delay. How a specific change can proceed must be clarified through the actual procedure. Promise neither automatic adjustment nor retrospective correction. Keep earlier versions traceable. The employee should be able to distinguish the version signed from the new decision now being handled.
Even when the scope remains unchanged, actual scheduling follows. Check the parts, people and other prerequisites against the current order. Approval is also different from payment of the grant. Evidence of use and its review remain separate procedural steps. Your sales team can explain the next operational action clearly without guaranteeing the later funding payment or a particular manufacturing start.
Hand over a contract position the office can use
A short, unambiguous overview in your existing records is enough for the handover. It connects the checked contract and attachments with the intended scope, expected implementation date and named responsibility for the application. Add the actually known signature, application and decision status. This overview does not replace the contract documents; it helps a colleague open the right ones.
Write outstanding tasks as specific questions. Does the schedule still need reconciling? Is confirmation of actual application receipt missing? Is scheduling currently checking execution? Such entries explain why the project is at a particular stage. A general note saying funding completed instead mixes preparation, decision and payment. Your team needs a clear connection between contract and next action rather than a new administrative apparatus.
This approach lets you sell a clearly prepared window service. The customer understands which basis they should sign and which decision follows. Your business can progress a suitable order without taking over somebody else’s funding responsibilities. The commercial benefit comes from a contract you can actually handle and a clear continuation of the customer conversation. An assumed certain grant does not replace your own quotation work.
New window contacts for your prepared sales team
On webRichtung’s German-language window offer page, you can register your business and review the described purchasing process. webRichtung supplies customer enquiries as a separate service. Funding assessment, contract drafting and authority to make a funding application are not included. Discuss dimensions, materials, quantities and installation scope personally with the customer.
Choose Germany nationwide or a German postcode with a radius of at least 25 kilometres, standard or exclusive delivery, and a monthly limit. Standard enquiries go to no more than three providers; exclusive enquiries go to one. The limit guarantees no volume. You see the current price before placing the order; delivery requires, among other things, industry approval, an order eligible for delivery and sufficient credit. Create your account on the German-language page and prepare relevant window conversations.
