Advising on legal cover modules: start with people and roles
Connect private, employment, housing and motoring wishes with specific roles and explain the proposal selection.
People comparing legal expenses policies often start by naming a package: private life, employment, motoring or housing. As an intermediary, your real work starts one level earlier. You want to understand which people seek support in which roles and which questions they need answered. This creates a reasoned selection. A familiar package name alone cannot connect everyday life with the protection described in the contract.
Move from an area of life to a specific role
Ask the prospect to describe the situations they want to prepare for. “Housing” might mean their own home or a property they let. “Work” might mean employment or an independent business. Record the role first instead of immediately opening a proposal under the broad label. The same person can occupy different roles in different situations, which should be considered separately.
The useful question is: “In what capacity would you like support in that situation?” This turns a general keyword into an examinable task. The prospect need not know the insurance terminology for types of benefit. Their description is your starting point. Your professional work is to compare it with the actual terms offered and explain how the requested situations are addressed there.
Consider people individually
Clarify who should have protection. Ask which people are involved and how they relate to the prospect, insofar as the advice requires it. A family in everyday language is not yet a confirmed group of insured people. For a shared policy, ask specifically who should be included. Then examine the relevant provisions and any information required.
It is particularly helpful to ask whether someone relies on existing co-insurance. Request the corresponding contractual basis. You do not need a complete family history to examine one inclusion question. Keep the reason for asking focused. If an affected person is absent, also make clear which information is second-hand and still needs confirmation.
Distinguish employment from an independent business
For work-related wishes, ask about the actual activity and the role in which support is expected. Someone who is employed and also self-employed may mean two different concerns by “my work”. Have both explained. An answer about their employment does not automatically resolve their business question. This is a good reason to divide the advice assignment before comparing benefits.
Ask the person to explain expectations for each role. Do they want to understand an employment relationship, for example, or discuss matters arising from their own business? Then examine the provisions in the actual offer for those concerns. If there is no reliable answer, mark the area for clarification. Another package label cannot replace a substantive answer about the business described.
Describe housing through its use
For property, establish whether the person rents, occupies their own property or lets it to others. Several uses may coexist. Link the requested examination to the actual property and role. A discussion of their own home does not resolve the question about a let unit. Clear allocation makes a later comparison understandable without silently treating different uses as equivalent.
Ask whether the use is expected to change. A planned letting can create a different future advice question from a permanently owner-occupied home. Treat a plan as a plan. For the offer considered, establish which details would matter if use changed. The prospect can then recognise when reassessment makes sense instead of treating a one-time choice as permanently suitable.
Clarify motoring without assuming a vehicle
When someone says “motoring”, first ask which situations and people they mean. Assume neither a particular car nor a particular use. They may mean their own vehicle or driving somebody else’s. The description of their wishes belongs first in the conversation. Establish which arrangement a policy covers afterwards from the actual documents.
Record significant differences when preparing several offers. A comparison is of little use if one reflects the stated situation and another an unconfirmed default assumption. Explain which people and uses each is based on. If a detail cannot yet be answered, leave it open. This provides an honest decision basis and avoids later corrections to an apparently finished comparison.
Assess support already available
Ask whether the prospect knows of support for certain concerns through other contracts or memberships. Request evidence of its actual scope before inferring overlap. BaFin recommends checking protection available elsewhere for individual areas. This is an additional question for your individual comparison, not a blanket replacement for legal expenses insurance.
Check particularly whether both routes concern the same person, role and task. A useful advice service and payment of further costs may be different things. Describe the evidenced scope plainly. If documents are missing, avoid asserting either duplicate insurance or a definite gap. An unresolved existing-cover question is useful in its own right and can be answered specifically.
Translate wishes into examinable requirements
Write a short requirement for each important area. For example: “The prospect wants their role as an employee considered in the proposal.” Next to it, put the question of which service and conditions are actually provided. These statements have different functions: the first describes a wish, the second an examination task. This prevents an expectation becoming an apparently confirmed policy feature later.
Priorities should also come from the prospect. Ask which points are essential to the decision and where they want to weigh differences deliberately. Do not invent a general ranking. One person may prioritise a particular employment situation, another a housing concern. Your comparison becomes clearer when it starts with confirmed priorities and places other characteristics in that context.
Resolve a case involving several roles
The following example is explicitly fictional.
A prospect is employed, takes independent assignments on the side and lets a flat. They ask for “private and work” cover. Ask whether they mean only employment or also their business. Also establish whether the letting should be included in the advice. Their answers determine which roles the comparison must address. The initial package name does not become the entire assignment.
They identify their employment as the main task. They want their business examined separately; for the let flat they first want clarity about existing documents. You can distinguish three different work statuses. For the first task, prepare the appropriate terms comparison. For the second, clarify professional responsibility. For the third, agree which contractual documents they will find.
This separation remains useful even if a combined proposal is ultimately considered. It shows which needs have actually been addressed and where information remains missing. The prospect can understand why an apparently larger package is not better merely because of its name. What matters is the actual connection between their prioritised roles and the confirmed benefits of the variant examined.
Read offers on the same basis
Use the same description of people and roles throughout the comparison. Record the documents and version of the terms belonging to each option. If one offer answers a question explicitly and another is silent, that silence does not confirm equivalence. Ask specifically. Understandable differences then emerge from actual content rather than the length of a benefit list.
Discuss the main differences against the requirements. “This option addresses the requested role in this way; that point is still open in the other” is more useful than a blanket star rating. The prospect should see how a difference affects their decision. If they deliberately choose not to pursue an area, record this too instead of allowing it to disappear unnoticed.
Connect the selection with a clear reason
At the end, ask the prospect to explain which roles they see addressed in the chosen offer and which deliberately remain outside the present examination. Their own wording shows whether your terms align. If this reveals a misunderstanding, correct that point before the decision. A courteously confirmed summary is more reliable than assuming a detailed conversation must have been understood.
Your recommendation connects confirmed wishes with the characteristics actually examined. Section 61 VVG sets the framework for establishing needs, advice, reasons and documentation. Use your own working overview for preparation; it does not replace required advice documentation. The prospect needs to understand the choice and remaining questions. Your business gains a comprehensible professional reason for the proposed outcome.
Finally, agree on a concrete reason for reviewing the selection later. This might be a change in occupation or property use that the prospect already plans. It is about a recognisable connection with the decision, rather than an arbitrary extra contact date. If the underlying role changes, the person should know which question they want to discuss with you again.
If none of the options reliably answers an essential requirement, a provisional decision not to select one is also a substantive outcome. Clarify whether to examine more offers or whether the prospect wishes to reconsider the requirement after a deliberate explanation. Do not change the priority yourself because a package is easier to sell. Agree what follows: which unresolved role to investigate, what answer is missing and what the next decision should build on. Even an initially incomplete comparison then remains actionable and understandable.
